Abstract

Objectives: To identify the characteristics of the judicial demands for drugs as part of the Bahia State Health Secretariat (SES-BA) from 2002 to 2008. Methodology: Cross-sectional descriptive empirical study with a qualitative and quantitative approach, whose unit of analysis is the lawsuit filed against the SESBA. Results: From 2002 to 2008 were identified 361 lawsuits against the State of Bahia, relating to the supply of medicines. Infliximab, trastuzumab, glargine and aspart insulins were the most frequent medicines requested; cancer, endocrine, nutritional and metabolic, and connective and musculoskeletal system diseases were more cited. About 30 % of the requested drugs were already provided by the SUS. Conclusions: Due to the fact that the most requested product was part of the SUS drug lists and drugs for cancer treatment are not provided by pharmaceutical area, it is necessary to spread the information for health professionals and legal professionals about the SUS rules and especially the pharmaceutical policy, the drugs selection criteria, how to access and use rationally the medicines.
